CS/HB 445 - Pretrial Detention and Release

HB445 has been approved by the House Criminal & Civil Justice Appropriations Committee by a 6 to 5 vote. The senate version, SB782, has received a temporary approval by the Senate Committee on Criminal Justice.

GENERAL BILL by Criminal & Civil Justice Appropriations Committee and Dorworth (CO-SPONSORS) Tobia
Pretrial Detention and Release: Requires all pretrial release programs to facilitate release of defendants from pretrial custody to conform to policies & restrictions established in act; preempts local ordinances, orders, or practices; requires that defendant meet certain specified criteria for pretrial release; requires that pretrial release program certify in writing that defendant satisfies eligibility requirements; requires court to determine defendant's eligibility after reviewing certain reports; requires that program notify each defendant of time & place of each required court appearance; provides that act does not prohibit court from releasing defendant on defendant's own recognizance & does not prohibit court from imposing reasonable conditions of release; prohibits program from charging administrative fees; provides that pretrial release program may charge fees for services ordered by court; provides that defendant may participate if defendant qualifies for specified programs; provides that pretrial release program registers be updated monthly rather than weekly.
Effective Date: October 1, 2010

The rest of the bail bonds

The rest of the bail bonds industry looks into a different perspective for pretrial as it may cost them their business. Any Vista Bail Bondsman will say otherwise when it comes to dealing with pretrial services as it only complicates the procedure when a bail secures an easy way out of the jail.

But then again taxpayers may opt to look into other options.
